Montgomery County criminal lawyer John I. McMahon, Jr., Esquire sat down with reporters and provided legal analysis on developments in the Cosby case involving felony sexual assault charges. In March of this year, the Montgomery County judge presiding over Cosby’s criminal retrial ruled that five other witnesses who have accused Cosby of sexual assault, or similar misconduct, will be permitted to testify at the jury trial this week. In Cosby’s first criminal trial, the same judge permitted the jury to hear from only one accuser in addition to Andrea Constand whose allegations are the subject of the aggravated indecent sexual assault charges against Cosby. McMahon, like most Montgomery County criminal lawyers, views the pretrial ruling as a victory for the prosecution.
Criminal lawyers for Cosby also had several recent favorable pretrial rulings. Last week, the Montgomery County judge ruled that jurors in Cosby’s felony sexual assault trial would be permitted to hear the contents of a civil settlement agreement between Constand and Cosby, including the amount of money that Constand was paid as a result of the settlement. In addition, the judge determined that Cosby’s criminal defense lawyers may present a witness who is expected to testify that Constand told her that she wanted to lie about being sexually assaulted to get money from a celebrity.
